Welcome to MontessoriKidsPlay (the "Marketplace"). These Terms of Service ("Terms") govern your access to and use of our website, services, and platform. By creating an account, listing an item, making a purchase, or otherwise using the Marketplace, you agree to be bound by these Terms. If you do not agree, please do not use the Marketplace.

1. About the Marketplace

MontessoriKidsPlay is an online platform that connects users who wish to buy, sell, rent, or exchange Montessori and educational children's products ("Users"). We provide the technology that enables these transactions but are not a party to any agreement made between Users.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Marketplace. By using the Marketplace, you represent that you meet these requirements and that all information you provide is accurate and current.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Listings and Transactions

Sellers are solely responsible for their listings, including descriptions, pricing, images, condition, and legal compliance of the items offered. Buyers are responsible for reviewing listings before purchasing. All transactions are directly between Buyer and Seller. We do not guarantee the quality, safety, legality, or accuracy of any listing or User, and we are not responsible for the completion of any transaction.

5. Fees and Payments

The Marketplace may charge fees for certain services, which will be disclosed at the time of use. Payments are processed through third-party payment providers, and you agree to their terms. You are responsible for any taxes arising from your transactions.

6. Prohibited Conduct

You agree not to: (a) violate any law or regulation; (b) post false, misleading, or infringing content; (c) sell unsafe, recalled, counterfeit, or prohibited items; (d) harass, defraud, or harm other Users; (e) interfere with or disrupt the Marketplace; or (f) use the platform for any unauthorized or unlawful purpose.

7. User Content

You retain ownership of the content you submit but grant us a non-exclusive, worldwide, royalty-free license to display and use it for operating and promoting the Marketplace. You are responsible for ensuring you have the rights to any content you post.

8. Disclaimers

The Marketplace is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free, or that any items or Users meet your expectations.

9. Limitation of Liability

To the maximum extent permitted by law, MontessoriKidsPlay and its owners, operators, and affiliates will not be liable for any indirect, incidental, special, or consequential damages, or any loss arising from your use of the Marketplace or transactions between Users. Our total liability for any claim will not exceed the fees you paid to us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless MontessoriKidsPlay, its owners, and affiliates from any claims, damages, losses, or expenses arising from your use of the Marketplace, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your access to the Marketplace at any time, with or without notice, for any conduct that we believe violates these Terms or is harmful to other Users or the Marketplace.

12. Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted. Your continued use of the Marketplace after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Marketplace owner operates, without regard to conflict-of-law principles.
